Who we are

This website and the rental service described on it are operated by Legends Car Rentals LLC, a California limited liability company, doing business as Legends Car & Van Rentals, 204 Hindry Ave, Inglewood, CA 90301 (“we”, “us”, “our”). In this policy “you” means the person visiting this site, requesting a quote, or renting a vehicle from us.

By using this website, contacting us, requesting a quote, or renting from us, you agree to this policy. If you do not agree, please do not use the site or our services.

What we collect

When you request a quote or make a booking we collect the information needed to provide the rental: your name, telephone number, email address, the dates and vehicle you want, and any trip details you choose to give us, such as a flight number. To complete a rental we also collect your driver’s licence details, proof of insurance and payment card information.

We collect the content of your communications with us, including emails, text messages, web form submissions and chat messages, together with recordings and transcripts of telephone calls that are handled by our automated assistant, as described below.

When you visit this website we may collect standard technical information such as your IP address, approximate location derived from it, device and browser type, referring page, and the pages you viewed, including through cookies and similar technologies.

Artificial intelligence and automated processing

We use artificial intelligence and other automated systems to help us run the business. This may include using AI to answer, route, transcribe and summarise telephone calls; to read, sort, draft and respond to emails, text messages, chat messages and web form submissions; to prepare and price quotes; to take and process reservations, bookings and changes; to assist with payments, deposits, charges and other transactions; to detect fraud, misuse and security risks; and to keep records of the above.

These systems are provided by third-party technology vendors that process information on our behalf under contract. Information you give us may be transmitted to and processed by those vendors for these purposes.

Automated output can contain errors. Quotes, prices, availability, summaries and other information produced or communicated with the assistance of AI are provided for convenience only, are not an offer or a guarantee, and do not bind us. Only a signed rental agreement and a confirmed reservation are binding. Where a decision materially affects you, such as whether we will rent to you, a person reviews it. You may ask us to have a person review any automated decision, and where the law gives you the right to opt out of automated decision-making you may contact us using the details below.

We do not permit your personal information to be used to train publicly available, general-purpose AI models.

Calls handled by our AI assistant

Calls to us may be answered by an automated AI assistant. Calls that are handled by the AI assistant are recorded and transcribed. Calls answered by a member of our staff are not recorded.

California is an all-party consent state. When the AI assistant answers, you are notified at the start of the call that the call is recorded and transcribed. If you continue with the call after that notice, you consent to being recorded and transcribed, and to that recording and transcript being processed by us and our vendors for the purposes described in this policy.

If you do not wish to be recorded, you may end the call and reach us another way: ask to be transferred to a member of staff, use the contact form on this website, or write to us at the postal address below. We will not treat you differently for declining to be recorded.

Text messages and email

If you give us your mobile number we may contact you by text about your quote, booking or rental. Message and data rates may apply, message frequency varies, and consent to receive texts is not a condition of renting. Reply STOP to any message to opt out and HELP for help. Email and text are not secure; please do not send us payment card numbers, licence images or other sensitive material by unencrypted email or text.

How we use it

We use your information to quote and fulfil your rental, to verify identity and eligibility to drive, to take payment and apply any charges arising from the rental, to contact you about your booking, to operate and improve our website and services, to prevent fraud and protect our vehicles and property, to establish, exercise or defend legal claims, and to meet our legal, tax and insurance obligations. If you have asked to hear from us, we may send occasional offers; every such message includes a way to stop receiving them.

Who we share it with

We share your information where the rental requires it, where you ask us to, or where the law does: with payment processors to take payment; with our insurers, claims administrators and roadside assistance partners; with toll authorities, parking and traffic enforcement where a citation arises from your rental; with the DMV, law enforcement, regulators or the courts where required or where we believe in good faith that disclosure is necessary; with our professional advisers; with a buyer or successor in the event of a merger, acquisition, financing or sale of assets; and with service providers who help us run the business, including hosting, communications, telephony, analytics and AI vendors, under obligations of confidentiality.

Advertising and analytics

This site uses Google Analytics, Google Ads conversion tracking and Clicky. These services set cookies and similar identifiers and receive information about your visit, including your IP address and the pages you view, which they may use to measure our advertising and to show you our ads on other sites.

We do not sell your personal information for money. However, under the California Consumer Privacy Act as amended by the California Privacy Rights Act, the use of advertising and analytics cookies of this kind may be treated as “sharing” personal information for cross-context behavioural advertising. We disclose it on that basis so that you can make an informed choice.

Do Not Sell or Share My Personal Information

You may opt out of this sharing at any time. You can do any of the following:

• Enable a Global Privacy Control signal in your browser or extension. We treat a Global Privacy Control signal as a valid request to opt out of sharing for the browser that sends it.
• Refuse or delete cookies in your browser settings.
• Use the Google Analytics opt-out browser add-on and the advertising settings offered by Google.
• Contact us using the details below and ask us to stop sharing your personal information.

We do not sell or share the personal information of consumers we know to be under 16 years of age.

Your California privacy rights

If you are a California resident you have the right to know what personal information we collect, use, disclose and share and the categories of sources and recipients; to request a copy of the personal information we hold about you; to request correction of inaccurate personal information; to request deletion of your personal information; to opt out of the sale or sharing of your personal information; to limit our use of sensitive personal information; and not to be discriminated against for exercising any of these rights.

The categories of personal information we collect are identifiers, customer records, commercial information, internet or network activity, geolocation data, audio recordings of calls handled by our AI assistant, and inferences drawn from the above. Sensitive personal information may include your driver’s licence number and payment card details, which we use only to provide the rental and for the related purposes described in this policy.

We will verify your identity before responding, usually by asking you to confirm details we already hold. You may use an authorised agent, in which case we may ask for proof of their authority and for you to verify your identity directly. We will respond within the time the law allows, generally 45 days, and may extend where permitted. Some information may be retained where we are legally required or permitted to keep it.

Vehicle tracking

Some vehicles in our fleet carry GPS or similar electronic technology, used to locate lost or stolen vehicles, to assist you in the event of a breakdown, to recover vehicles that are not returned, and where you ask for our help during a rental. This is disclosed in the rental agreement.

How long we keep it

We keep rental records, communications, recordings and transcripts for as long as we need them to run the business, to resolve disputes, to enforce our agreements, and to meet tax, insurance and legal requirements, after which they are deleted or anonymised.

Cookies

This site uses cookies to keep it working properly, to understand how it is used and to measure advertising. Most browsers let you refuse or delete cookies through their settings, and many support a Global Privacy Control signal. Refusing cookies may affect parts of the site.

Security

We use reasonable administrative, technical and physical measures to protect the information we hold. No website, transmission or storage system is completely secure, and we cannot and do not guarantee the security of information you send us or that we hold. You send information to us at your own risk. To the fullest extent permitted by law, we are not liable for unauthorised access to, or loss, alteration or disclosure of, information that occurs despite reasonable measures.

Children

This site and our services are not directed at children. We do not knowingly collect personal information from anyone under 13. If you believe a child has given us personal information, contact us and we will delete it.

Other websites

This site may link to websites we do not control, including map, review and payment providers. We are not responsible for their content, security or privacy practices, and this policy does not apply to them.

Disclaimer

This website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the site or any content, quote, price, availability or automated output is accurate, complete, current, uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, neither Legends Car Rentals LLC nor its members, managers, officers, employees, agents, contractors or service providers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to this website, this policy, our communications with you, or our use of artificial intelligence or automated systems, whether based in contract, tort, strict liability, statute or otherwise, and whether or not we were advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to this website or this policy will not exceed the greater of the amount you actually paid us for the rental giving rise to the claim, or one hundred United States dollars (US$100).

Nothing in this policy excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud, wilful injury, or violation of law. Some jurisdictions do not allow certain exclusions or limitations, so parts of the above may not apply to you.

Indemnification

You agree to indemnify, defend and hold harmless Legends Car Rentals LLC and its members, managers, officers, employees and agents from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or relating to your use of this website, your breach of this policy, your violation of any law, or your infringement of the rights of any third party.

Binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.

Any dispute, claim or controversy arising out of or relating to this website, this policy, or our communications with you, including the use of artificial intelligence or the recording of calls, will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Los Angeles County, California, and governed by the Federal Arbitration Act.

You and we each waive the right to a jury trial and the right to bring or participate in any class, collective, consolidated or representative action. The arbitrator may award relief only in favour of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. If this class action waiver is found unenforceable as to any claim, then this arbitration agreement does not apply to that claim, and that claim will proceed in court.

Either party may bring an individual claim in small claims court instead of arbitration if it qualifies. Nothing here prevents either party from seeking injunctive relief in court to protect intellectual property or confidential information.

You may opt out of this arbitration and class action waiver. To do so, write to us at Legends Car Rentals LLC, 204 Hindry Ave, Inglewood, CA 90301 within 30 days of first using this website or first agreeing to this policy, stating your name and that you opt out of arbitration. Opting out will not affect any other part of this policy or our willingness to rent to you.

If any part of this section is held invalid, the rest remains in effect.

Governing law

This policy and any dispute arising from it are governed by the laws of the State of California, without regard to its conflict of law rules. Subject to the arbitration section above, you and we submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

Changes

We may update this policy at any time. The date at the top of the page shows when it last changed. Your continued use of this website or our services after a change means you accept the updated policy.
